Please read these Terms of Service (the “Terms”). They form a binding agreement between you and HyperMesh Network Pte. Ltd., a Singapore private limited company (“ApexVerify”, “we”, “us”, or “our”). By accessing or using our websites or services, you agree to these Terms. If you do not agree, do not use ApexVerify.
- What these Terms cover
- Websites: apexverify.com and app.apexverify.com (the “Website”).
- Services: real‑time verification of email addresses, phone numbers, and postal addresses, dashboards, APIs, documentation, and related features (the “Services”).
- You: the individual or entity using the Services (“you”, “Customer”, or “User”).
- Who may use ApexVerify
- You can create an account without special requirements. To buy paid credits or enter a binding contract, you must have legal capacity in your country.
- The Services are not intended for children under 13 (or under 16 in the EEA). We do not knowingly allow such users to create accounts or submit data. If you are under the age of majority, use the Services only with a parent or guardian’s consent.
- You must comply with all laws that apply to your use of the Services.
- Your account and security
- You may sign up with email/password or via OAuth (Google, LinkedIn, Apple, Twitter/X, GitHub).
- Keep your login and API keys confidential. You are responsible for all activity under your account and keys.
- Multiple accounts: we do not limit you to a single account. However, we may deny or remove free credits, or suspend accounts, if we suspect abuse, gaming of promotions, fraud, or violations of these Terms.
- Free credits
- New accounts receive 100 free credits to test the Service.
- Free credits do not expire, but they are lost if your account is deleted.
- Anti‑abuse: we may remove free credits or restrict access if we suspect misuse (for example, mass creation of accounts to farm free credits).
- What we provide (nature of the Service)
- We verify email, phone, and postal address data using third‑party networks, carrier databases, and reference datasets. We depend on those third parties for speed and availability. Outcomes may vary by provider, country, or network conditions.
- Verification results are for operational checks (e.g., deliverability or reachability). They should not be the sole basis for business decisions. We do not promise that a verified email will never bounce or that a verified number/address will always be reachable or accurate.
- Some lookups may return “unknown” (for example, if a carrier or data source is temporarily unavailable).
- Credits, pricing, and usage
- One “credit” is the unit we charge for a verification event.
- Current default credit costs:
- Email verification: 1 credit per email.
- Phone verification: 10 credits per phone number.
- Postal address verification: as listed on our Pricing page and/or in the app.
- We may offer different tiers or premium lookups that use more credits. The current prices and credit costs are shown in the app or on our Website. We may change prices and credit costs at any time with notice on the Website and/or by email for material changes.
- Unknown results and undetected syntax errors:
- If a lookup returns “unknown”, we automatically return the spent credits for that lookup.
- If our system fails to detect an obvious syntax error and still charges credits, we return those credits.
- Payments, invoices, and taxes
- Pay‑as‑you‑go: you purchase credits in the app. Payments are processed by Stripe. We support the currencies Stripe makes available to us; the currency and amount you see at checkout are the ones that apply. Your bank or card issuer may charge fees or use their own exchange rates.
- Invoices/receipts are emailed automatically after each purchase.
- GST/VAT: We do not charge Singapore GST until we are required to register (currently when revenue meets the Singapore threshold). If this changes, we will apply taxes prospectively and notify you as needed. You are responsible for any other applicable taxes in your jurisdiction.
- Refunds and chargebacks
- All sales are final. We do not provide cash refunds for purchased credits, except where required by law.
- Credits returned for “unknown” results or undetected syntax errors are re‑credited to your account (not refunded in cash).
- If you file a chargeback, we may suspend your account and charge any associated fees we incur.
- Data protection and privacy
- Roles. For customer‑supplied personal data that you ask us to verify (emails, phone numbers, postal addresses), you are the “data controller” and ApexVerify is your “data processor.”
- Lawful basis. You must have a lawful basis (e.g., consent, legitimate interests) before you submit any personal data to the Services. You must provide all required notices to data subjects and honor data subject rights. You must comply with applicable laws (e.g., GDPR, ePrivacy, Singapore PDPA, CAN‑SPAM, TCPA, CASL, local DNC rules).
- DPA. Our Data Processing Agreement (DPA) forms part of these Terms and is available for e‑sign in the app (we use email OTP). The DPA governs privacy, security, international transfers (including use of Standard Contractual Clauses), and sub‑processors.
- Location of processing. We process and host operational data in Europe (EEA). We may use vetted sub‑processors (listed on our Website or DPA). If data is transferred across borders, we will use lawful transfer tools (e.g., SCCs) and Singapore PDPA transfer requirements (comparable protection).
- Improvement of Service. We may use aggregated and anonymized statistics (that do not identify a person) to improve our Services and for reporting.
- Privacy Policy and Cookie Notice. Please see our Privacy Policy and Cookie Notice for details on what we collect about you as a user of our sites and apps.
- Your responsibilitie
You agree that you will:
- Only submit data that you are allowed to process and share under applicable law.
- Not use the Services to build, enhance, or append profiles about a person without lawful basis.
- Not use the Services for stalking, harassment, doxxing, discrimination, or any unlawful purpose.
- Not use the Services for credit, insurance, employment, tenant screening, or similar uses regulated by FCRA‑like laws.
- Not submit children’s personal data (under 13 in the US, under 16 in the EEA) unless you have verifiable parental consent and all required legal bases.
- Follow all telecom, anti‑spam, and marketing laws (e.g., GDPR/ePrivacy, CAN‑SPAM, TCPA, CASL, DNC rules).
- API and fair use
- License. We grant you a limited, non‑exclusive, revocable license to use our API and SDKs to access the Services.
- Keys and rate limits. We may set or change rate limits, throttle requests, or suspend API access to protect the platform or other users.
- No reverse engineering or scraping. Do not attempt to access our systems in unauthorized ways or extract bulk data.
- Benchmarking. Public benchmarks or comparisons that identify ApexVerify are not allowed without our prior written consent.
- Service availability
- Best effort. We aim to keep the Services available, but we do not promise any specific uptime or response time. Maintenance, outages, or third‑party issues may occur.
- Third‑party dependencies. The speed and accuracy of results may depend on carriers, postal authorities, and other data providers we do not control.
- Content and intellectual property
- Ownership. We and our licensors own the Services, software, interfaces, design, databases, and content on the Website. All rights are reserved.
- Your content. You remain responsible for the data and files you upload. Keep your own backups. We are not responsible for loss or corruption of your uploaded files or outputs.
- Data retention and deletion
- Workspace data (files/results you upload): by default, we delete after 90 days of account inactivity. You can choose shorter retention in your account settings.
- Account inactivity: if there is no login or API activity for 90 consecutive days, we may delete your account and data. We will email reminders (e.g., around day 30 and day 60) before deletion where possible. Unused free and paid credits are lost upon account deletion.
- Logs/metadata: we keep only what we need for security, fraud prevention, and billing while your account is active. When you delete your account, we delete related user data, except we may retain billing records, invoices, and logs needed to meet legal, tax, and audit duties.
- Self‑service deletion: you can delete your account in the dashboard. This will remove your data as above. Some records (e.g., invoices) may be kept as required by law.
- Changes to the Services or Terms
- We may change or discontinue features at any time.
- We may update these Terms. We will post the new date at the top. For material changes, we will also notify you by email or in‑app. If you keep using the Services after changes take effect, you accept the updated Terms.
- Suspension and termination
We may suspend or end your access (with or without notice) if:
- you breach these Terms, our DPA, or policies;
- we suspect fraud, abuse, or security risk;
- you fail to pay amounts due; or
- we must do so to comply with law or protect others. If we delete your account for these reasons, unused credits are forfeited and no refunds are given.
- Disclaimers
- The Services are provided “as is” and “as available”.
- We do not promise that results will be uninterrupted, timely, accurate, or error‑free, or that all data sources will be available at all times.
- We are not responsible for decisions you make based on the results. Use your own judgment and additional checks where needed.
- Limitation of liability
- To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption.
- Our total liability for all claims in any 12‑month period will not exceed the greater of: (a) SGD 100, or (b) the amounts you paid to us for credits in that 12‑month period.
- Some places do not allow certain limits; where prohibited, those limits will not apply, but the rest will.
- 1. Indemnity
- You agree to defend and indemnify ApexVerify and our officers, directors, employees, and contractors from any claims, damages, losses, and costs (including legal fees) arising from your use of the Services, your breach of these Terms or the DPA, or your violation of law or third‑party rights.
- 2. Third‑party sites and links
- Our Website may link to other sites or services. We do not control them and are not responsible for their content, terms, or policies. Please review their terms and privacy notices.
- 3. Export and sanctions compliance
- You may not use the Services if you are, or you work for, a person or entity on any sanctions list, or in a country embargoed by Singapore, the U.S., the EU, or the U.K. You must follow all export control and sanctions laws that apply to you.

- Governing law and venue
These Terms are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction over any dispute that is not resolved informally.
- General
- Entire agreement: These Terms, the DPA, and any referenced policies are the entire agreement between you and us about the Services.
- No waiver: If we do not enforce a term, it does not mean we waive it.
- Severability: If any part of these Terms is invalid, the rest remains in effect.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
